View Full Version : What Happens To Your DirecTV Equipment After A Bankruptcy?

So I had to delcare Bankruptcy. Which really sucks, but Thank God that's an option! I miss DirecTV but God they are so expensive.

Anyways, so now I'm not sure what to do with my existing HD DVR and Satellite. I believe I'm still technically "leasing" the reciever, but after the bankruptcy goes through do I then "own" the device and hence can sell it to someone else on Ebay?

Just trying to figure out what I can and cannot do at this point. Please, people who are sure of an answer respond. Not if your just guessing. I mean I can do that!

Sorry to hear about the Bankruptcy. Honestly I am not sure but I would guess it would still need to be returned to DIRECTV since it is a leased unit or you will receive a bill for the full amount of the unit for not returning it.

Hopefully someone will know for sure for you but I would suspect it will need to go back to DIRECTV.

I don't see how a receiver leased from DIRECTV can be affected in any way by a bankruptcy. DIRECTV owns it and if you don't give it back to them when you cancel service they will charge you for it. The dish on the other hand is yours to sell.

Send them the reciever back with a letter of your bankruptcy. They will close the account right then an dthere. Once they see the case# they are smart enough to know that they wont try collections. Of course call them 1st and explain to them your situation. I am sure your not the 1st.

BTW, when you cancel they will send you a prepaid box to ship the receiver back in.

Only assets are tied in with a bankruptcy. With this being a leased receiver its not an asset. You could theoretically keep the receiver and then Directv would charge you their fees which would be included in the bankruptcy. But from the sounds of it you are done with them so why keep it. You will probably have to list Directtv as a creditor in the bankruptcy filing. Of course you will be paying an attorney big bucks so you could just let them send a letter to Directtv and have them handle it. I had to file for bankruptcy due to medical bills ($80K :eek2: ) as I couldnt keep up with what the Hospitals were wanting me to pay. You will still have that guilty feeling of wanting to pay everyone as usual but this is a time to step back, enjoy the break and redevelop a new financial plan for the future. I filed back before the new laws went into effect, so you may be in for more of a headache then it use to be. Good luck. and enjoy trying to credit and/or loans for the next 7-10 years :lol: but seriously the laws are there for a reason and it really serves a purpose

Is it Chapter 7 or Chapter 13 you filed for? One wipes out all debt, the other does a repayment schedule! Good luck.
