Classic Communications is ready to sue EchoStar, alleging that the satellite TV company is sending false and misleading statements to its cable customers, according to court papers cited by Dow Jones.

The wire service said that today the company will ask Judge Peter J. Walsh of the U.S. Bankruptcy Court in Wilmington, Del., to issue an order temporarily restraining EchoStar from targeting and contacting subscribers of Classic's cable service in an attempt to try to induce them to subscribe to the DISH Network satellite TV service.

Classic also wants the court to prevent EchoStar from making "false or intentionally misleading statements" to existing or potential Classic customers concerning the company's financial condition, reorganization prospects, likelihood of emergence from bankruptcy, or ability to continue providing services, Dow Jones said.

Classic Communications, headquartered in Tyler, Texas, filed for Chapter 11 bankruptcy protection in Delaware in November.

EchoStar said it believes the company's marketing efforts toward Classic cable customers are appropriate. "Apparently, Classic cable doesn't want its customers to know that they have a choice when it comes to pay television. We believe their allegations have no merit," spokesman Marc Lumpkin said.
