The carriage dispute between ABC Family and EchoStar heated up again Thursday, with court documents from the network suggesting that the skirmish could impact agreements ABC Family is negotiating with other multichannel providers.
According to a written declaration supplied by EchoStar from John Burns, president of distribution for ABC Family, the network is talking with other program distributors about keeping ABC Family on their platforms. "There is a significant risk that a sudden drop in Family's subscribers, through termination of the EchoStar agreement, would impair Family's negotiations with these distributors, as well as its ability to compete successfully for unaffiliated distributors in the future," Burns said.
The other distributors Burns referred to cover some 37 million viewers for ABC Family, the document said. Presently, ABC Family is negotiating with six unnamed distributors. "These distributors represent almost half of Family's current subscribers," Burns said.
In his written declaration, Burns said the network collects roughly $1.1 million a month from EchoStar. Based on information ABC Family has received from Nielsen and through internal estimates of its audience, Burns said the network could lose 7 percent of its paid subscribers if EchoStar doesn't carry the channel.
"Apart from the loss of approximately $1.1 million per month in revenues that would result directly from EchoStar's termination of the affiliation agreement, a figure that has been growing month-to-month, (ABC Family) would also suffer injury in the form of damage to its goodwill, credibility and reputation," Burns said in his declaration.
