I had submitted a request to DirecTV to come test my home for OTA West channels to have a waiver granted.

The original request was submitted 4/18. I had not heard back from them on a result and sent a certified letter in mid-June requesting the test again as per the 30 day requirement.

I have still not heard of a result.

What are my next steps to get this resolved?

I have NY Locals but am requesting LA waivers and so far only NBC was granted.

Any suggestions to get Fox, ABC and CBS West?

I think if the local station does not give a response in 30 days that they have to turn the station on for you that you are automatically granted approval for it. I do not know how you would go about this but I would call up DirecTv and ask them the status of the waiver application.

We got refusals from the local stations initially. That's what prompted me to request the on-site signal test. They have yet to do it.

Read that on fcc.gov. D* is saying they have 45-60 days, not the 30 required. They're checking into it, but I don't really expect to get them.

Any other suggestions (legal) on how to get the West channels if I live in the NY DMA (and still get the NY locals)?

You don't expect to get the tests performed, or you expect to get the tests but not get the west feeds as a result of the tests ?

If the tests show you are inside the Grade B contour for OTA reception, that's it. End of story, game set & match, no appeal, no west feeds for you. Consider yourself lucky to even get NBC west.

If the tests show you are below Grade B for OTA reception, you will be granted access to west feeds for each network whose signal was sub-Grade-B after the information is sent to both Directv and the local channels affected by the results.

Either way, the test ends the matter as far as D* is concerned. "Moving" to a white area address somewhere inside the NY DMA would fix the problem for you, but good luck finding one :) .

And yes, I consider "moving" legal. It may be a violation of your service contract with D* or E*, but you are paying for the channels you get AND there are no penalties attached to "moving" other than having your "fake" locals replaced with your "proper" locals if you're ever found out. Therefore, I consider it neither illegal or immoral.

Giving D* hell seeing as I requested a signal test for CBS back in MARCH and still havent heard anything from D* or WFSB. I keep throwing at them the whole SHIVA thing with 30 days and they insist they have 45-90, well any way you look at it they are still over the alloted time for my signal test!

Northern Dutchess County, NY is that magical white area where you'll get both NY locals (including the independents) and LA distants. Check some addresses in Pine Plains, NY. They're in the 518 area code, yet in Dutchess county and in the New York DMA. Dish's search engine turned up some wonderful results in this area. IIRC, there's a road on the Dutchess/Columbia border which qualified for everything. If you're willing to move, this is the way to go. I haven't personally done this since I've got the Tivo to timeshift, but if you're interested in LA news and whatnot, it's worth a try (and only a 5 min. phone call, too).

You should look into moving to get those LA channels yourself. It comes in handy to have a 3-hour delayed backup feed on the major networks, especially during the summer thunderstorm and winter snowstorm seasons.

You also get extra football/ baseball/ basketball/ hockey games, and live LA freeway chases :D

LOL! Flashbacks of the OJ freeway chases... beautiful!

I live about 30 mins. south of there... it's extremely rural, yet still in the NY DMA. The Albany stations (TWC here carries ABC10 from Albany, towns further north get more) actually cover this area newswise, while the NYC networks were last here during the Sharpton/Brawley case in Poughkeepsie. They completely ignore us and call us "upstate," which is a curseword to most people here. I'll probably "move" to an Albany white area, get their locals when they come online, then subscribe to NY + LA distants. I've had this planned out for awhile ;)

Alas... it was too good to be true.

Pine Plains, NY is in Pegasus territory. So essentially you'll be paying for those distants if you want them. I'll continue to search for something else, but it looks doubtful now.

And I found it....

Roscoe, NY is in Sullivan County and in the NY DMA. Not in Pegasus territory, either.
