claiming false advertising.

The "most HD channels" coupled with "starting a $29.99" has always been a sore point with me.

Kinda saw this one coming. To be honest it got on my nerves everytime I saw a Directv commercial stating they had the capacity and even in one commercial stated they now have 200 HD Channels.

Yea, maybe we will get lucky and the court will make BOTH companies submit their advertising to the court for approval prior to allowing them to air. Both companies have disgusting morals in their advertising departments.

Yeah if only their was some government agency (http://www.ftc.gov/) that regulated advertising.

There haven't been any ads from Directv saying they have 200 hd channels, only the capacity.

Which technically is also untrue since D12 isn't at 103 yet and won't be for a month or 2 it seems like.

It was one of those commercials where it shows the 2 screens. on one side it's Dish and the other it's Directv and at the end they say "and now with over 200 HD CHANNELS" I tired to find it on YOUTUBE but to no evail.

At this point it doesn't even matter anyway the big question will be, Will Directv's D12 Satellite release the HD Channels before Dish's new Satellite that just launched which according to them will also give them the "capacity" for 200 HD Channels. Frankly I'm sick of hearing the crap from both of them. On one hand you get way more HD Channels but their so compressed it's not even worth the money and on the other hand we keep being feed hype and speculation with a side of alleged claims and yet to be promises keeping everyone's blood pressure thru the roof!

Kind of hypocritical of DirecTV to sue Dish and then turn around do so the exact same thing. Interesting though that DirecTV didn't even try to defend the ads but rather simply stated ""it's obvious the lawsuit is in response to our recent objections to their misleading advertising.". I guess it's okay to do if someone else does it first?
I'd like to see a court order that they put up 200 HD channels for $29.99 ;-)

My blood pressure is fine. I try not to let it bother me. Yeah I'd like more HD; but until I get it I'll just sit back and enjoy the HD channels D* does carry. It may not be 200 but its still twice as many as Comcast.

I think that technically it is true at this point from a capacity perspective and depending on how you count it. That being said, no way DIRECTV does that now because doing so would affect other services or perhaps quality of service.

With 10 dishes and a tin foil hat. :p
i don't know for you, but I am really sick of these battles.
I have more HD, no WE have more HD, yes but mine are real HD, yours are not, my packages are cheaper, yours are expensive, yes but we do have 1080p and 3D, we have the best On Demand library, you don't, Blah blah blah blah blah :nono2: and who pay for all these craps, US customers. :(
I know it's part of business, but please give us a break, concentrate on things more important than these battles.

I think it is kind of misleading saying they NOW have the capacity for 200 channels when D12 is still being tested and delayed even more so.

$30 is the promo price and the dish $30 thing is promo as well.
But DISH also counts there part time RSN's HD as full time HD. and they also don't have the room to show all the RSN's + over flows in HD at the same time. So some games that are in HD on directv may not be in HD on dish. Also some RSN's have a lot of NON game HD shows and more that you don't see in HD on dish as well non live game replays.

...and we all know Comcast is being 100% truthful in their recent ads when they claim to have 10 times as much HD programming as either satellite provider.

D12 will be in place by the time any court hears the case, if it even goes that far.
Actually, they have the capability now. All they need to do is shutdown SD and go all-HD, all-MPEG4, all the time

I'll say the same thing I said on another site:
Just like when Direct sued Dish, this should not be brought to the courts. Let them fight it out in the market, like they have been doing.
I said all along that the best thing for Direct to do was to fire back at Dish with their commercials, and now I will say the same about Dish. The best thing for them to do is to fire back at Direct with commercials of their own.
A good example is the current DirecTV, "To Tell The Truth" commercial where Direct claims to have more full time HD Channels. This is true when you count PPV and RSNs. What Dish should do is something similar to what Direct is doing to counter Dish's "Same TV for Less" claim; Dish should simply do a commercial listing all of the HD channels that they have that Direct does not. This alone will be effective and counter DirecTV's "More full time HD" claim.

Find it and I will rescind my statement. Until then, I maintain there is no ad where Directv says they have 200 hd channels.
How about we give both of these bickering boys a spanking and then send them to their rooms without any dinner?
Thats what the judges in these cases should do for this crap.

When did they add the "+"?

Most advertising is misleading in some way.
Like this one: "most movies in 1080p HD, the same stunning quality as Blu-ray":lol:
Dish Networks Lawsuit will backfire. The commercial clearly states DirecTv "Will Soon Have The Capacity For 200 HD Channels" It does NOT say they actually "Have" 200 HD Channels up and running. Dish Network's beef with DirecTv's add should be the laughing stock of that court day.:D

per MCN they don't like the wording either:
..."the DirecTV "To Tell the Truth" spots attempt to compare the Dish AT120 and DirecTV Choice Xtra tiers."

They could light up 200 channels today if they wanted in HD.. Where they would be coming from and having to shut down any small sd channels
notwithstanding...
Which of course is the problem with advertising.. If technically they could do it, its legal... The burden of proof is to show its NOT at all possible.. While very rarely is a false representation really held liable for anything these days.. Otherwise you;d see every marketing company suing the other..

Dish Network has the worst lawyers. Their stubbornness in the TiVo case has been well documented and now they pick this fight?!?

Exactly. They could turn off the SD and offer 200+ HD, or what could spaceway do if they stopped the spots

Folks, it's all in the count. Marketing speak is not necessarily the same as technical speak.

D* has never said they have 200 HD channels. All the ads say they have 130 HD channels. The early ads said they would "soon" have the capacity for 200 HD channels. Then after D12 launched they changed the ad to say they "now" have the capacity for 200+ Hd channels. I agree that the change to the ad should not have been made until D12 was actually done testing at 76 and was parked at 103, but I work in engineering not marketing.

I caught the end of a directv ad the other day (one of the ones with two tvs for dish & directv) and thought it might have been about the HD-lite that Dish uses. Could it have been? If not, why does directv not push that as an advantage, would seem to play well to the current focus of 1080p tvs?

I think that D* had an ad like that but I don't remember for sure. I think that was why E* then came out with an ad that had people looking at the two TVs and they said they couldn't see the difference so why should they pay more for D*.
Most advertising is misleading in some way.
Fast food advertising. I can guarantee you cannot get a sandwich that looks like the advertised one at any fast food restaurant.
D* has never said they have 200 HD channels. This is true. All the ads say they have 130 HD channels. The one I got in the mail today says "over 130". WhereIsMyHD.com said (last week, before it was disabled) that they have something less than 100.The early ads said they would "soon" have the capacity for 200 HD channels.I don't recall them advertising (as opposed to announcing as part of financial reporting) HD expansion until after the launch of D12.
The flyer in my bill today said capacity. It had a picture (representation) of D12. I guess once it gets in the air, parked and transmitting or not, they count it.

I'm pretty sure the "soon" ads were around before Christmas.
Just checked and Swanni wrote an article complaining about the ad on December 1st, 2009.
So how much $$ does D* have set aside for its legal proceedings, and how much $$ of our subscription dollars goes to that set aside?
