Smart Cards are a commodity, not proprietary technology. The fact that D* can sue on these grounds is preposterous. From everything I have read the only people who are being sued bought the technology from hack sites. Why would a legitimate user buy from these sources?
A bad decision.
Lots of people buy smart cards just to look at them, not to use them for illegal purposes. Just like people who buy crack, but not to use, just to have some.

The reason given by a few of the folks who have been proven to not be stealing signal centers around trying to find ways to incorporate the cards into computer security and buying from those sites was a very cheap option.
If you can spend only $50 of your own money and maybe find a way to start a multi-million dollar business, why wouldn't you.
From what I've read, at least 4 of the folks seemed to be going the same direction. Using smartcards as security access to computer terminals. You would need to put your card into a smart card reader before the computer would let you access anything.

if you really believe that, there is a nice shiny blue and white Boeing 747 parked on the tarmac in the hot Texas sun I would be happy to sell to you - at quite a savings if you act fast!

Several years ago I went looking at figuring out a way to do something with smartcards. I'd wanted to use it as an operator ID card for amusement rides we create. Hunting around online I found almost the only places i could get anything reasonably priced was from these "hack" sites. I shelved the project before ordering anything as no one seemed terribly interested in the idea around here when I brought it up. Nowadays, they're more prevalent and available.
