Gemstar TV Guide reiterated its position Monday that it still believes the company has a strong case in patent infringement litigation targeting EchoStar and others. The company also revealed that one of its top executives will depart in two weeks.
Gemstar, best known for its interactive program guide technology, argued its case on alleged infringement of company patents by EchoStar, Pioneer and Scientific-Atlanta during an International Trade Commission hearing in December. "We are confident in our position, we believe that we made a forceful case in the December hearings, and we, like so many of our investors, await a decision," Gemstar Chairman and CEO Henry Yuen said Monday.
The ITC is expected to release its findings on the patent infringement matter Thursday.
In a big development at the IPG company, Gemstar said Peter Boylan will step down as co-president and co-chief operating officer on April 1. Boylan will remain as a consultant to the company, Gemstar said.
Before going to work for Gemstar, Boylan served as president and chief operating officer of United Video Satellite Group, from 1996 to 1998, a business that was acquired by Gemstar through its purchase of TV Guide. During his time at Gemstar, Boylan oversaw Television Games Network, UVTV, TV Guide Affiliate Sales and C-Band packager Superstar/Netlink, among other businesses.
In other personnel moves, Gemstar named Jonathan Orlick executive vice president and general counsel, a promotion from his role as senior vice president and deputy general counsel. The company also appointed Mark Allen to the new position of executive vice president of technology licensing.
The Monday news was part of Gemstar's release of fourth quarter results. The company said consolidated EBITDA for the three-month period totaled $118.6 million, on consolidated revenues of $346.4 million. That data compares to consolidated EBITDA of $112.3 million on consolidated revenues of $358.1 million for the same period in 2000. Gemstar also reported a net loss for the quarter of $210.2 million.
