According to an article in south Florida's Sun-Sentinel (http://www.sun-sentinel.com/), a change in Florida state law, effective Oct. 1, now prohibits homeowner associations (HOA) from filing leins on a homeowner's property. This is good news for both existing and potential DBS subscribers who reside in communities controlled by a HOA and have feared being fined for "improper" use or placement of a satellite dish on their owned property.
For decades, the filing of propety leins has been the ultimate "big stick" HOAs have used to force collection of past-due association fees or unpaid fines levied by the HOA. With that leverage removed, Florida homeowners need no longer fear such actions. It should be noted, however, that the change does not prohibit the levying of fines by HOAs, and other legal remedies may be available to homeowners associations for the collection of amounts owed.
