I'm going to be moving to a new house that's community has an HOA and Sat. is not allowed. Charter Communications in the cable provider and is my only choice. I'll be getting Digital Cable but what is the big difference besides price???
Also, is there a Fourm for cable people like me :( (to be)?

THey legally CANNOT stop you from getting satellite tv! I don't have the link right here, but will post it tomorrow, if someone doesn't beat me to it, which I bet they will!

I also have both. AE package from Dish. Comcast for the HD locals. I'd say the PQ is the same for HD channels for both. I thought about switching to Comcat for everything, but the DVR rental fees are outrageous.
As noted above, your HOA seems to be clueless about the law. I'm inclined to think that HOA rules in general were formulated in the C-band era, wanting to keep huge dishes from decorating the landscape. Does the HOA also prohibit outdoor TV antennas, ham radio antennas, CB antennas and the like? (ham radio and CB antennas aren't covered by the FCC rule, but outdoor TV antennas for receiving local stations are.
Looking at Digital cable vs. Dish, consider the following: comparative cost, availability of HD network feeds (OTA is certainly the best way to go if available, picture quality (in my area, digital cable quality is nowhere as good as satellite), available programming, ease of installation. I'm sure there are other factors to consider, but these are good for starters.

We are going to do major renovation or perhaps even tare town current home and start over, in the mean time my wife has already moved into a rental house wile I temporally stay at old home with the animals. At the rental house we could not get a line of site for satellite do to many large trees in the back yard, so we are having to settle with Comcast digital cable their. I have found I like the E* receivers much better, E* has the better epg, I like E* clear brouse banner and clear info's much better, the Motorola box that Comcast uses, has solid brouse banner and info screen with add's, yuck. The one feature I do like on the cable box is that the brouse banner will allow you to go further into the future then the one on E* which only allows next show. I also found that the analog channels on Comcast to be a little grainy, digital channels are almost = to E*, however HBO that we get free for 1 month, the pq did not seam to be on par with HBO on E* when I have seen it on E* during Free previews. I will miss satellite once I move out and into the rental house with my wife, but for now we have both and once the work is done and we move back into are current home we will go back to satellite exclusively.
