OK, the 942 (9200 for us Canucks) is going to be released in Canada next month by BEV and apparently NBR is going to be disabled :(

My question is would the reason for BEV to have NBR disabled be due to the fact that they only provide a 44 program guide and NBR chokes on it? I personally believe that is the case as I think the guide does not provide enough information to NBR to function correctly, if at all.

BTW, the 9200 is going to sell for $599 CAD :)

You are correct. I was told that NBR does require some additional information that is NOT in the 44 EPG data stream (and, most likely, never will be). And according to my source the design and implementation of NBR on the Echostar designed receivers was done so it did not infringe on the TiVo patents.

My guess is that ExpressVu will add the extended guide (with NBR support) sometime in the future. All of the new DVRs will have NBR so it would make sense for them to add it.
