DirecTV reseller suing EchoStar

    Douglas County - EchoStar Communications Corp. is running "false and misleading" advertisements that say Pegasus Communications Corp. customers may lose satellite TV signals when Pegasus' contract with DirecTV Group Inc. ends, a suit says.

    DirecTV, the biggest U.S. satellite-television provider, and the National Rural Telecommunications Cooperative earlier this month ended Pegasus' exclusive contract to resell service to 8.4 million U.S. households in 41 states. The move, effective Aug. 31, prompted Pegasus' satellite-TV unit to file for bankruptcy.

    DirecTV said it wants to take back rights to market its service in Pegasus' territories because it has been losing customers there to EchoStar. The suit filed by El Segundo, Calif.-based DirecTV seeks a court order to block EchoStar's "misleading" advertising campaign and to force EchoStar to issue written statements that there will be no service disruption.

    What a bunch of crybabies. D* exploited the hell out of the Viacom situation with E*. I saw a commercial telling people to switch to D* the DAY the viacom deal happened. But yet when E* exploits one of D* misfortune's, they get all butt hurt about it.

    The key word here is "may".

    Hey Time Warner cable was running radio adds that claimed clouds (just clouds) could interrupt satellite reception.

    It doen't matter what Cable or DirecTV has advertised in the past. Dish is being sleazy on this one. Pure and simple. They should be above that sort of crap.

    There was a thread about this over on SG, I believe under "retailer chat".

    It is a lie to intentionally blow a situation completely out of proportion. D* did that.

    Telling the truth is more than a statement of facts.

    D* did go after subs over viacom, there was the possibility that E* customers would lose channels and they did, even Charlie acknowledged the possibility of lost channels. D* has repeatedly said no one in Pegasus territory will lose service because of these disputes, customers will be notified how to switch.So E* lied, whats so new about that.

    Ummm. No it isn't.

    Lying is a deliberate mistatement of fact. Truth is an accurate statement of fact.

    DirecTV used the fact of Dish losing Viacom channels to draw new subs. They did not do the same thing during the Turner negotiations, because that wasn't the case, and would have been a lie.

    Dish is being untruthful in their current DirecTV/Pegasus ad campaign.

    But, even if DirecTV was dishonest in their ad campaign, that would be no excuse for Dish to resort to untruthful and sleazy tactics. Their is never any excuse for that. Leave that sort of BS to Comcast and such. (Their anti sat and anti DSL campaigns are pure BS.)

    There's also Fox Sports Net. Probably more.

    It's karma. Charlie was one to toss around lawsuits like frisbees, for a while.

    Charlie really deserves this one.

    On the last retailer chat they said they were making up doorhangers to hang on peoples doors who live in Pegasus areas and have DirecTV service, the hangers said something to the effect of

    You might lose your DirecTV service. Switch to Dish Network now to avoid loss of service

    Jim Defranco said on the chat it was good to market this because of the customer confusion.

    I think its actually a low way to go. Dish is also paying a $50 bounty to installers for signing up new Dish customers in those areas.

    I agree 100% on this one. In the past I have taken up for E* when people have complained about wording such as DVOD and 150 local markets etc, these are just marketing bs and are not all out lyes, however this thing with the D* Pegasus dispute is an out and out lye, Charlie and the E* marketing people should be ashamed of themselves on this one and deserve to get sued. I am very disappointed with E* on this one. :(

    So now you all want to jump ship on Dish? Because you don't like the way they do an advertisement? What they are saying is a T R U E statement. They say M A Y lose your service. Unless DirectV gets out and explains everything to the customers with notices and letters and personnel telephone calls. If you are a Peagusis customer and don't know these things. Then one day you may turn on the TV and guess what. No picture. Alot of these customers live way out in the country. Direct has this habit of suing there own customers on suspicions. So why wouldn't they sue everyone else. Sometimes I may complain about the way Dish treats customers or the way they do certain things. This is a case of Dish being right. Some of you may even be DirectV customers wanting to vent. But thats OK to.
