Good luck, it is just the rights of the individual are being "crushed" by these big companies and there "exclusive contracts". Heck my Mom has dish network installed in her home, I had a directv dish on the house (it was no longer in use since I moved out), the guy took it off of the house, and used the bottom part of the dish (the part that bolts to the house) on the new dish dish, I went and got the directv dish (the upper half), and brought it to my home, and was like W$F when half the dish is missing, thankfully I had a spare dish here and took off the bottom half and put it on my 3LNB dish.

On 7/8/2011 Directv charges me for 2 receivers one DVR at ($175.00) and a Standard STB for ($45.00), good grief!!


Note: Directv did reverse the equipment charges

I went through something like this years ago at my last residence and the Home Owners' Assoc. chief "condo cammando" started chest pounding only to find that the rules/laws were in my favor and he went from King Kong to little monkey QUICK!:lol:

She didn't get someone to do her work; rather, it was more coincidental that the very moment I walked in (unannounced and unexpected) to discuss an impending renovation, the leasing manager literally just hung up the phone with her regional manager.


Maybe I was a little quick with that one.

My thought was..."this is not me...THIS IS CORPORATE SPEAKING!" I watch for the man behind the curtain when I hear allusions to greater authority.

Yes, I'm keeping records, but I don't think the lease renewal will be a problem. I was in yesterday to sign papers for my new lease and the renovation of my unit and my having to switch to another unit for a month this summer while they renovate my current one. They even have my deposit already for the one-month rental of the corporate suite while mine undergoes its remodeling.

Plus, like I said, if they decide to screw me with non-renewal, I'll make sure every person in this complex knows about their DBS dish rights. FYI, a few years ago--two property managers ago--I ran into a similar situation when that property manager (not her boss, the regional manager, like this time) told me to take my dish down. I showed her the OTARD rules and she backed down, but then she takes me aside and quietly says to me, "Please don't tell anyone else here. If they ask, we'll just say you're grandfathered."

Translation: "Please don't tell anyone else here that they, too, have the legal right to possess a dish like you. We'd prefer they have to go through our single provider because we get some of the kickback."


I would explain that to the Manager and also remind them that they would lose in a Lawsuit which you are prepared to do and if they decide to terminate your lease then they will see another lawsuit.

I would also point out and underscore the part in the FCC Rules that you are within your rights and if they try to take down your dish I would tell them that your attorney will be right over with a restraining order until a judge can rule on the issue.

I believe that once they see you are in your rights and you will not back down they will quietly go away but I would tell everyone in the complex about the FCC Rules so that they will not suffer like you are doing or cave in because they don't know the Federal FCC Rule or Law.

I would complain to the regional manager:

Sir,

The bitch dog you left to run your property will not stop following your orders. She constantly probes to see if I have begun to take down my dish. I insist you get her to back off until this matter is completely litigated.

Gee, I guess in a 22-building, 440-unit complex, I feel somewhat unique, privileged even. I apparently stand alone. Nevertheless, it'll be a hot day on Hoth before I take my dish down!

If you don't have any right now, I'd take some photos of your dish as it is currently installed. Both from your patio/deck and from a street view. Just in case they remove your dish while you're not at home.

I've lived in my particular complex for 12.5 years. My current Slimline dish is on my balcony (2nd floor), not protruding over the edge and on the inside post of my balcony railing--nice and secure.

Every condo and home association is different in how far they go in permissible locations for satellite dishes, so I'm curious if you had to get permission to attach the dish to the inside post of your balcony? I know many folks have been told they could only keep the dish if they don't drill through condo property - in other words, the only way is a pole in a bucket of concrete sitting in the middle of their private use patio or balcony. Could they get you on grounds that you "damaged" their balcony post?

I don't want to dampen your enthusiasm or spirit, but just though it might be something to prepare for ...

A few years ago they asked me to remove it. I submitted to them the FCC's OTARD rules and they backed off (begrudgingly). Today, when visiting my leasing office for something else, I was informed that their regional manager has ordered me to remove my dish immediately. She claims that they have that right because they have a central dish that serves the whole complex. They do, but it's DISH Network (who signed an exclusivity deal with the complex), and it was enacted in 2005, 7 years after I moved and installed my dish.

Let me guess.... NFL Sunday Ticket, right?
