Section E sounds like something set up on a very limited area of property. Branching out across ownerships and right-of-ways would complicate things enormously.

Obviously it would have to be demonstrated that such a system would serve better than a series of individual systems and that would only be assured if everyone is in a signal shadow. The application seems very limited and depends on lots of contracts and incorporation.

Of course section E only applies to the CATV portion of the offering and getting the broadband part up and running with its attendant monthly fees is likely to complicate (or possibly even invalidate the application of section E) things immensely.
