DirecTV Drops Suit Against DISH

DirecTV said it sent notice to the U.S. District Court in Los Angeles that it's withdrawing the false advertising claim it recently filed against EchoStar.

DirecTV claimed EchoStar was using false advertising to mislead Pegasus customers into believing they would lose DirecTV service due to the legal skirmish between the companies. Since EchoStar has agreed to stop using the ads as a result of the lawsuit, DirecTV has withdrawn its claim, the satellite TV company said in a statement. EchoStar also instructed its dealers to stop using the ads, DirecTV added.

"While we're pleased with the corrective action taken by EchoStar, the case will be dismissed without prejudice so that, should EchoStar resume any form of misleading advertising, we will seek appropriate relief from the court," DirecTV said.

The case - and the EchoStar advertising - got tangled within the legal proceedings involving DirecTV and Pegasus. A number of Pegasus subsidiaries are in Maine bankruptcy court, which has become the venue of the DirecTV/Pegasus spat and the fight over whether Pegasus can retain is exclusive deal to sell DirecTV in rural territories. DirecTV has been working to sell its service directly to consumers in Pegasus areas.

I am glad that E* dropped the adds, to bad it took the threat of a law suit to make them see the error of their ways on this one. :)

That's good. The Dow Jones Industrials have only gone up 12% since the low point in June of 2002. Echostar went up 63% in the same time period. Glad you found something better.

(The Nasdaq went up 31% over roughly the same period.)
