Cancelling Service, breaking contract... how to not pay?

I foolishly just bought an R15 reciever and re-upped for 2 years thinking we'd be in our apartment for some time, and after we'd move, it'd be into a single family home that we bought or at least rented.

Well, then the landlord came through and informed us of 90 days to get out... they're converting to condos and all tenants are being evicted. :(

So we found a condo to move in to... we love it... its bigger, the living room is pre-wired for surround sound... has everything we want. Except the HOA requires dishes to be on the balcony.

Two problems. 1.) the Balcony looks south, but its right next to a tree thats pretty dense. Line of sight would be strained at best. However, the balcony is upstairs off the master bedroom, accessed by a sliding glass door. 2.) the owner, our landlord has expressly prohibited any drilling through the walls. I'm not really keen on leaving the sliding glass door open to run wires through to the multiswitch. I'm even less inclined to have wires run all around the house, including down the stairs by an installer who cares more about getting outta there to his girlfriend or whatever (if you can't tell, I've never had a good DirecTV installer... my first one tried to charge me extra because I had a DirecTiVo I purchased @ Circuit City, instead of the generic unit, despite the fact that it required no extra work... second guy refused to run 2 lines to my dual tuner DirectTiVo).

Anyway.... DirecTV is of course telling us to pay up for breaking contract.... citing the FCC Rulings.... but not recognizing the limiting factor that I'm renting from a private owner who is restricting the install (I'd run it down the pipe into the water heater if I could.... but I can't).

Anyone got any tips?

Everything I've read says if you return your equipment in good condition you're allowed out of the contract.

When did you buy the R15 if before March 1st you should be able to return the R15 to Directv to cancel your contract. If you leased it after March 1st you have to return the receiver any way so you also have to pay the early termination fee.

DTV will help you in this case. You just need to call in and explain what has happened to the Retention department. If you play nice, you can get out of the contract.

Before, when I would check my account online, it would say along with Total Choice, DVR Service, Protection Plan, it would also say annual commitment or two-year commitment. Now, it doesn't say either of those things. It just says Total Choice, DVR Service and Protection Plan. Does that mean that D* slipped and I am no longer under contract? I am kind of hoping so because I have to move soon and its looking like the new landlords will not allow my dish and wiring where it needs to be installed. Any input anyone?

You case is a "special" one.

It is covered by one of the exceptions, being that you are forced out of your property and your new one doesn't have the ability to get DirecTV.

You shouldn't have the problems you are having.

Talk with customer retention or ask for a manager level person.
Offer to provide them with the "get out letteR" if necessary to confirm.

Thanks for your response. I have an upcoming meeting with representatives of the management company for the new property. I plan to discuss with them where they will allow dishes/wiring, etc. The official rule is that they will allow dishes but only in specified areas, the usual yadda yadda. However, this new place I will be moving into is a townhouse. I will need Sat connections in the living room obviously and upstairs in my bedroom. I think that is where I will be having problems....wiring. I am hoping for the best as I am really wanting to keep my D* service. However, if the management company will not allow the setup that I need, I will be forced to go back to Comcast (god I hope not, LOL). Like I said I know when I signed up for D*, my profile included the "annual commitment" or "two year commitment" in the list of my services. Now, it's nowhere to be found. I just wonder if D* slipped and I am not in contract anymore. Let's just say that I am and the new management company will NOT allow me to have the setup I need, will D* let me out of my contract?

Or they should at least offer you the opprotunity to return the equipment.

Do they provide a "home run" central TV cable distribution? Perhaps you could plug your dish in there.

Thanks for the replies.

Yes I bought my R15 before 3/1... I was unaware of the "Return to cancel" deal cuz damn that thing SUCKS...

But I'm not happy about having to leave the big D. Our cable system sucks.. (although they've sweetened the deal to give me a TON more premium channels for less than D* for 18 months with no contract) but like I said, our back was up against the wall....

SO as long as cable gvies you a bunch of free stuff, or real cheap service, its ok?

This quantity or quality issue is one of the prime reasons that none of the providers are doing as good a job at providing the best possible service anymore...

I know its not your only reason, due to your unfortunate move circumstances...

Of course not. The thing thats going to be most annoying is that I'll have to re-learn all the channels.... and losing the XM to listen to while I host my poker games.

I called and the retention specialist I spoke with seemed to let it go... they tried to get me to agree to an installer coming out, but I straight up told her it wasnt' going to work (I used to work with a large independent Home Theater design and installation company here in SoCal... so I know that the tree out front obscures too much...) and that I really wish it was going to... but it just wasn't going to happen.

She was funny... "well what about behind a window?"

The windows that face south are the sliding glass door to the balcony... my upstairs bathroom, and my window over the kitchen sink. So either it'd be in my sink, in my toilet, or in my bed. Yah I don't think so.

Thank you all for your advice. Hopefully we'll be back on the D* soon!
