Del Taco Worker Allegedly Stabs Customer Who Complained About His Order

    I have seen a couple of different articles which indicate that the employee reached out of the Drive-Thru window and stabbed the gentleman while a couple of others give the impression that the employee walked outside and the two got into a physical altercation which in turn led to the stabbing.

    This is another example of how in this story and many others posted here we really have no idea what happened. Then the posters start engaging in pure speculation. Does anyone know if anyone has been charged in this incident? That would be a good starting point at getting at the truth.

    As I understand it, the stabbing has no connection with a "GANG" but rather the accused is a known "GANG MEMBER"

    I would understand it as the driver been a member of other gang and the conflict wasn't about food.

    That's what we're good at. We have speculation threads (some technically called anticipation) that last an entire quarters and speculate on things that won't happen for a year to year and a half from now.

    I would have thought so as well.
    California is one of many states which has a "GANG ENHANCEMENT" which can be tagged on to any violent act if the accused is labeled a known/suspected gang member.

    Did this Del Taco have available for its customers cable-television programming, shown on any HD screens, from the likes of DirecTV or Dish Network (or a cable provider like Comcast or Time Warner Cable or Charter Communications or Cox or Verizon FiOS or AT&T U-verse)?

    It requires more than just being a known or suspected gang member. The crime must be committed for the benefit of, at the direction of, or in association with the gang with the specific intent to promote, further, or assist criminal conduct by gang members. It is difficult to prove this allegation, requiring the testimony of a gang expert and documentation of prior crimes by the gang.

    The section you googled comes to play during the sentencing phase. There is a lot more to that section including how someone can be charged with a this enhancement in advance by having something as simple as a gang tattoo.

    Being charged with something does not always mean charges will not be dropped at some point or that if it does come to trial that you will be found guilty of it.

    The section comes into play during the trial phase. The trial may be bifurcated, but it comes into play during the trial phase. If found true, it then, like any other allegation that is found true, comes into play during the sentencing phase.

    Having a gang tattoo, with nothing else, is not enough proof. If you were charged with a violation of this section, and the only evidence was a gang tattoo, the charge would be dismissed by a judge and would never get to a jury.

    Are you a trial lawyer or judge? Unless you are, you won't mind if I don't take your word on things like this. For someone who has posted how much they dislike people speculating in threads such as this, you seem to engage in it quite a bit.
