I love this thread.
I have a petition pending with the FCC as we speak. I filed it April 6, 2010 and we, (us and the FCC ) are still duking it out with our HOA today. My drama started in May 2008 and, with all due respect makes Lord Vaders experience look like a nice walk in the park on a sunny day. When I finally make our story public, and I will, you good people will simply not believe it.
LV, you should file the petition even though you currently have your dish installed. Our's is installed and the FCC id still pursuing it. In fact, the fact that you have a petition pending give your Dish protection for your landlord attempting to enforce any rules that you allege to be prohibited. The first thing the FCC will do is notify your landlord that they are to refrain from enforcement until the petition is closed.
Make sure you follow the filing requirements such as an affidavit and serving all necessary parties simultaneously.

I served as chairman of our HOA's Architectural Review Committee for ten years just to prevent situations like yours. Among other things, I made sure that our HOA restrictions were reasonable and did not violate OTARD or any other regulations.
I am not surprised that the FCC ruled in yor favor and I expect they will rule in Lord Vader's favor.
It is clear that pre-approval is not permissible. It would be permissable to state that, if possible, dish installation should not be in front of a house; however, if the installer says that the only place that will work without increasing the cost of the install or decreasing the signal strength is in front of the house, then unless you live in a designated historical district, the burdon of proof is on the HOA to demonstrate that there is an alternative that will work as well as in front of the house. An outright prohibition of an installation in front of the house is not allowed.

Nothing yet. I'll keep you posted. I'm dealing with an unrelated crisis right now anyway, so I'm going to be a bit busy.

OK...How about just putting a sticker on your dish, that says, "FCC APPROVED"?
It would be hard to find a sticker of 30" size.
Painting it on would be better.
Just a minor update...
My apartment complex has a long history of reviews on a site called ApartmentRatings.com. Recently, a few folks have Emailed me through that site because they saw a long review posted by me. My review was favorable, but I did state in it that if anyone was thinking of moving here and wanted to retain or get DirecTV service, they should contact me for details on how to do it, because they would most likely be told they can't get such service if they mentioned it to the leasing office.
Sure enough, these people who have contacted me all said they were told by management that they couldn't get a dish. One Email today said, "Management told me I couldn't bring my DirecTV service here. They said I had to go with DISH Network because DISH is the only approved provider of satellite service in the complex."
Another Email to me last week asked, "Can you tell me how to get DirecTV service at my apartment? I'm moving in there in November and was told they don't allow dishes and that I had to go with their own."
It's obvious that management just won't stop this BS. Sure, it doesn't affect me anymore, but they still are spewing these lies.
Someone ought to do something about this... :slowgrin:

I work in loyalty/Retention at dish network now and when ever a customer says there going to Dtv i sometimes joking say "ahh your going to the dark side?", now i know its true.
Dtv has darth vader and i am envious xD
Great thread though i spent pretty much all night reading every post and think you rock Vader.
Keep spreading the word to your neighbors and review sites, the apartment management shouldnt get away with this
