EchoStar responded at the Federal Communications Commission concerning Pegasus' allegations that sales staff associated with the satellite TV company are using the pending merger between EchoStar and DirecTV to convert Pegasus subscribers.

In a letter sent to the FCC, David Goodfriend, director of legal and business affairs for EchoStar, said the company takes the allegations very seriously and it investigates each matter. "Unfortunately, the investigative effort has been hampered by the fact that in many cases the allegations made by Pegasus lack documentation," Goodfriend said.

Goodfriend added that EchoStar has not been able to corroborate many of Pegasus' allegations. "Sometimes, for example, it is difficult to identify the source of the statements cited by Pegasus, including whether the source is even a retailer who sells EchoStar products," he said.

In EchoStar's opinion, Pegasus is encouraging the FCC to step into a private commercial dispute, Goodfriend said. "Contrary to the best interests of consumers, Pegasus has chosen to attempt to protect and expand its business through attempts to block a merger, rather than to compete aggressively on price and service," he said.

In recent weeks, Pegasus has contacted the FCC concerning its allegations that DISH Network sales and/or independent retailers are contacting its DirecTV customers, telling them they need to convert to DISH Network because of the pending merger.

Pegasus knows its days (months) are numbered. If it was truly concerned about ethics, it would investigate its own excessive profit-taking, sadly deficient customer service and it's faulty, bordering on criminal billing practices. That D* granted quid pro quo territorial exclusivity based on NRTC's congressional mandate is the height of arrogance. A classic example of government-sponsored economic terrorism of clueless consumers unfortunate enough to reside under the jack-boot of protected corporate greed.

Pegasus is as necessary as tits on a bull, and is soon going the the way of the glass milk bottle. It is complaining in a feeble attempt to save its own ass. No doubt its own shills are saying the same things in reverse about the pending merger.

That Pegasus is complaining about a few of E*'s shills is tantamount to a prostitute *****ing that her favorite john's wife is giving it away for free.

I once worked for that outfit Nick and everything you mention above is spot on and then some. Not a proud reminder on my resume at all.
