EchoStar said the U.S. District Court for the Western District of North Carolina granted a motion for summary judgment against Gemstar, dealing another blow to the company and its efforts to protect patents for its interactive program guide technology.

According to the satellite TV company, the court found that none of EchoStar's products infringe on any of the patents asserted by Gemstar. Accordingly, Judge Lacy H. Thornburg dismissed the case and awarded EchoStar its court costs.

Earlier in the month, Thornburg previously ruled that all but two of EchoStar's products did not infringe on the patents asserted by Gemstar. With respect to the two products, Thornburg requested additional information before reaching a final ruling.

In the order handed down late last week, Thornburg ruled that the remaining two products also did not infringe on the asserted patents, EchoStar said in a statement.

Earlier in the summer, a judge with the International Trade Commission ruled against Gemstar-TV Guide and its claims that EchoStar and other set-top box manufacturers infringed on its interactive program guide patents. That case is being reviewed by the full ITC.
