Is there any legit way to contest a waiver denial?

(I do not want to buy a boat, motor home, or get a Mailboxes Etc. address in another county.)

I can put up the biggest antenna I can buy, and my OTA signal sucks. Getting the local HDTV OTA signals is a complete joke, yet I lost my Distants when I activated my new 6000 reciever, and all but NBC have denied the Dish-applied for waivers.

I am 30-50 miles from my locals towers, live in a valley behind large hills, and will NEVER get a good signal OTA. (I am in Eastern Connecticut)

I know this is probably on old topic for you guys, but do I have any options?

SHVIA has a provision that requires the provider (Dish in this case) to arrange for the conduct of an on site signal strength test.

From an FCC news release:

In its Order, the FCC also designated the American Radio Relay League (ARRL) as the "independent and neutral entity" that can designate the person to conduct a signal strength test at a subscriber's household. The SHVIA establishes procedures whereby broadcast stations can grant waivers to satellite subscribers who are predicted to be able to receive local network station signals off-the-air, and therefore are ineligible to receive distant signals via satellite. The SHVIA also provides that if waivers are denied, consumers can request a signal test to determine the actual signal strength received at their homes.

If the broadcast station and the satellite provider cannot agree on who should conduct the test, the ARRL will designate someone to conduct the test. The FCC determined that the ARRL is a particularly appropriate choice for this role because it has no commercial connection with delivery of television services, it has field offices across the U.S., and its members are actively engaged in activities related to the measurement of radio field intensity. So, let's take this a step further. I live in the NYC DMA and get my locals via E*. I qualified for West NBC and ABC feeds, but keep getting denied for FOX and CBS feeds.

What can I do to get the other 2 West feeds approved?

I checked the SHIVA pages and could not find a place to register to have a site survey done, or at least initiate a request for one. Is there a more precise link?
