Here’s proof that Dish is in contempt !!!!!!!!

I received the following phone call this morning, 12/21/2006, from Dish Network.

"We are pleased to inform you that All American Direct has been approved to offer distant ABC, CBS, NBC and FOX network channels to eligible DISH Network customers using existing DISH Network satellite equipment. You may be able to receive Atlanta and San Francisco distant network channels from All American Direct using your existing DISH network satellite equipment!

Please call All American Direct at 1-800-909-9677 or visit their website www.mydistantnetworks.com to see if you qualify. All American Direct can assist you in the approval process.

Thank you for being a loyal DISH Network customer."

I have caller ID and when I redialed the number, 1-866-668-8047, it was Dish network.

Now tell me that Dish isn't in in contempt of the injunction !!!!!!!!!!!!!!!!!!! :mad:

Ok, Dish isn't in contempt of the injunction. Happy now?

They're not in contempt because Dish isn't in the business of providing DNS. They are letting you know, as a former Dish DNS customer, who can help you. Why does this irritate you so much?
Because he works for the NAB? ;)
It seems to me that if you have to be a E* customer (which is suggested but not stated as a requirement), then there is a problem. I suggest that people ask, in passing, when talking to NPS whether or not this is the case.

Honestly how are any of us hurt by this? The only people who seem to really give a hoot seem to be those w/ a personal axe to grind against E* and just desperately want to see them punished and are scared to death that maybe they might not be suffering enough. If this is such a big deal to you and you really feel somehow you are somehow personally injured by this then go hire yourself a lawyer and take E* to court.

This will be my last comment on this matter. E has broken the law and done things they're own way, no matter who gets hurt. In doing so they have cost me and many others a lot of money and anxiety. This morning I got an unsolicited phone call from them and I haven't been with them for about 2 months. :mad:

So you are a non E* customer who was informed distants are available via NPS?

"Proof" of contempt would be refusing to serve non-E* customers or requiring E* to approve all subscriptions. While there were some early day bumps, there have been enough reports of non-E* subscribers getting NPS distants to kill that proof.

E* running commercials for NPS isn't contempt.

Actually, we don't know that.

This was never a point addressed by the jurists during the original contempt motion filed by the plaintiffs. The only real issue addressed was the contract that leased transponder space from Dish Network to Echostar.

And the plaintiffs can refile with new information. The injunction is permanent, so any points that weren't addressed in the original contempt motion could be readdressed in another motion.

A RVing friend has an old, inactive, E* receiver and is getting only the distant nets from All American, no E* service what so ever.
Jeez, I can't believe how invested some of you guys are in expanding the scope of E*'s punishment. They're out of the DNS business. They lost millions of dollars per month in DNS revenue. They don't make another dime from NPS whether they have 1 DNS customer or 1,000,000. They're probably out millions in legal fees. What do you want, blood?

No, I am just pointing out the obvious: the only way someone can be found in contempt because of a specifc action is if a party complains to the courts and the courts find them in contempt because of that specific action.

If now Dish Network starts advertising for NPS, it is possible to be considered "in participation". However, this time I'll leave that for the courts to decide.

Man, you don't stop. Here is an extract of the judge's explanation as to why HE did not find E* in contempt for leasing satellite space to NPS:

That EchoStar has found a way to minimize harm to its customers and itself, and likely prevent a windfall to its competitors, does not require this Court to modify the injunctive relief entered to encompass conduct not intended to be banned by the Act or the Eleventh Circuit's mandate, and the Court does not find good cause to enter such broad relief.

He made it crystal clear that E* is not selling DNS and that NPS can. He also made it clear that E* found a way to retain customers (send them to NPS) that was lawful. The plaintiffs made it clear in their motions that E* was explicitly sending DNS customers to NPS. The JUDGE found this lawful.

got the call too but i'm happy with dish for 9years now and cant think of a reason why you would want to rat on them?
Well not trying to be a prick or nothing but all I can say is screw this new rule that E* cant provide DIstants its stupid anyway. I could care less whether there in contempt of the court or not. Personally I find it funny they found a way to stick it to the man. We should be able to watch whatever channel we want to watch. Who cares how much money the local channels in our areas lose. It dont affect me in the least way. If I want to watch CBS in Kansas City so what? I hate my local CBS. All I can say is screw the NAB they can go straight to heck and screw the Florida judges they can go there too. Its a crying shame they waste our tax dollars worrying about what were watching on TV. They could have spent that money on something helpful instead of hurtful to us. :nono2: :mad: :eek2:

The Plaintiffs have already made a complaint centering on how E* was promoting NPS more than any other option in the "Charlie Chat" and E*'s provision of the propriatary customer list to NPS. Both were part of the record when both the Magistrate and the Judge decided that NPS and E* were not in contempt. To claim that any other form of advertising, such as direct mail and telephone solicitation, is a violation after having the court already decide that the personal closed circuit endorsement and the provision of customer lists that were used for pre-screening were not in contempt seems to be a stretch.

The issues of E* advertising for NPS and E* providing customer lists to NPS have already been raised - and dealt with. If the plaintiffs want to go back for another round of whipping it's their money. Personally, I don't see them doing that.
As a customer of the free market I am totally contemptuous of the NAB and every other friggin ahole out there that thinks they can dictate what we can and cannot watch, what we can and cannot buy. Screw them. The whole idea of duplicating the transmission of CSI, Survivor and Trading spouses 50 times over is just plain stupid.

Just imagine if we had 50 channels of discovery channel or any other non-net channel you can think of ... And you thought SPAM PORN was a waste of bandwidth ... HA!
You won't have 50 versions of a network ... just the one in your market and possibly one from a neighboring market (if E* gets permission to add those back). Works nicely as long as the local affiliate is playing the network.

The statement says "Echostar has found a way....."

I don't understand how that logic can be used to conclude that NPS is acting independantly.
