It is up to E* to find space on a satellite and make arrangements with the stations to get permission to air their digital signals. Transmitting digital stations isn't a requirement - although in 2009 when analog stations are turned off digital will be the only stations left to rebroadcast. 
That doesn't mean they will be in HD. That battle is still ongoing.
